HOW TO PLACE ORDERS (from the UK)


ONLINE ORDERS  - USING THE SHOPPING CART

Click the Add to Cart Buttons on this website to buy cards, notelets, prints, pictures, scarves , accessories and ready-to-wear clothes.  This will take you to a shopping cart in which you can add or remove items, update the contents and either continue shopping on this website or continue to checkout and pay using a credit or debit card, funds from a PayPal account or make a bank transfer via the PayPal site.  You do NOT need a PayPal account to use your credit or debit cards on this shopping site.


Just fill in the online form at checkout and enter your details.  These are totally secure as the PayPal website is fully PCI DSS compliant, and the Add to Cart buttons on this site are encrypted.  Your financial details are totally confidential; I will not have any  of your card or bank details as the financial transactions take place on the PayPal website, not on mine.


You will be sent a notification from PayPal that your payment has been received.  I will also receive a notification from them and will acknowledge your order as soon as possible giving you an indication of how long it will take to process.  I will then send you an e-mail as soon as the item(s) have been posted to you, with a tracking number from the post office (or courier if it is a large item).  If you order through the add to basket buttons on this website and the item has sold out then I will let you know as soon as possible after I receive your order and if you have paid through PayPal then your money will  be refunded through the PayPal website.  No substitutions will be sent without your permission (see Substitutions below)


OFFLINE ORDERS - E-MAIL, PHONE, FAX OR POST

If you do not wish to use the Add to Basket buttons on this website then you may place your orders by sending the etails in an e-mail to: info@annefontenoy.co.uk, contact me by telephone on 01892 521153, or post your order to  Anne Fontenoy, 36a Clifton Road, Tunbridge Wells, Kent TN2 3AR


CONFIRMATION Your order will be confirmed to you before it is sent.  Please check confirmations so that errors can be corrected, if possible, before the order is completed and sent to you.  This is particularly important when ordering cards or prints because these items are made individually to order so it is essential that the details are correct before I make the cards or order prints for you.   If an incorrect ready made product is sent in error, please return it and I will pay for the cost of 1st Class postage to return it, provided that there is proof of posting in the event it is undelivered.  I will send you the correct item with no further delivery charges.


SUBSTITUTIONS  If a product is no longer available I will let you know as soon as possible.  Many of the ready made scarves, dresses and accessories are one-offs and they cannot be reproduced, so if the one you want is no longer available, you could either order a different product that is available from stock, or the order can be cancelled.  I will NEVER send you a substitute without your prior agreement.  If you cancel because the product is no longer available and you have already sent me payment (i.e. a cheque or postal order sent by post) I will return your payment to you immediately, including all delivery charges.  If you requested to make payment via PayPal then I will only send you a request for payment via the PayPal website if a ready made product is in stock.  If it is not in stock I will automatically cancel the order, and I will not, therefore, send a request for payment to you from PayPal, but will instead let you know that the product is no longer available.


ADJUSTMENTS OR CHANGES TO ORDERS

If there are any problems which require adjustments or changes to orders for cards or prints that are made to order, I will discuss these with you and agree how to proceed.  If any money has been sent to pay for these by PayPal and the order cannot be fulfilled, or less money will be due, I will have either the full amount or the balance remaining after the new total, returned to you via PayPal or, if, there are any changes to the order which you accept and which incur more charges, then I will make a further request for payment before proceeding with the order.  Adjustments for payments made by cheque, postal order, cash or bank transfer, will be made for these type of changes by arrangement and are required prior to completion of the order.



RETURNS POLICY FOR DISTANCE SALES (DISTANCE SELLING REGULATIONS)

for cards, prints, pictures, scarves, headdresses and ready made silk dresses purchased at a distance (not face-to-face sales) See below for terms for made to order clothes


Ready Made Products

Please examine products with reasonable care before use and make any claims for faulty or damaged products or for shortages, in writing, within 30 days of the day after delivery.  Products will be deemed to have been accepted unless notification in writing is received within 30 days of the day after delivery.  Repaired or replacement products or a refund will be sent to the consumer for faulty or damaged ready made products which have been examined with reasonable care and returned with their original packaging.  The cost of 1st class postage for returning faulty or damaged products will be refunded.  Proof of posting will be required if returned products are not delivered to Anne Fontenoy.  A refund will be given for written cancellations that are made prior to despatch of the order.  Written cancellations will also be accepted up to 7 working days after the day of delivery of an order.  Please return unused and undamaged products with their original packaging, but the customer bears the cost of return postage.


Customized or personalised products

A repair or replacement will be offered if these are received in a faulty or damaged condition, and will be made within 30 days of receipt of a written notice for claims if the products are returned to Anne Fontenoy, having been examined with reasonable care by the consumer and returned with their original packaging.  Once both parties have agreed the details of such products, these orders may not be cancelled if production has commenced.  A 7 working day cooling off period will be offered before production commences.


Any repairs to either type of product will be made by Anne Fontenoy at her place of work.


HOW TO MAKE A PAYMENT FOR OFFLINE ORDERS

All orders for cards, notelets, prints, pictures, scarves, accessories and ready made clothes must be paid for in advance.


BY DEBIT OR CREDIT CARD OR FROM YOUR PAYPAL ACCOUNT

Place your order by e-mail (or include your e-mail address with orders sent by post or fax) and I can send a payment request to you in the form of an e-mail sent from the PayPal site which has a link back to the PayPal site.  You do not need a PayPal account, but this link will enable you to make payments for my products, via PayPal, by debit or credit card.  PayPal will send an e-mail notification to your of your payment very soon after you make your purchase.  I will also contact you to let you know when your goods have been posted, and include any relevant tracking so that I will know when your goods have reached you safely.  Payments made using PayPal are secure and are PCI DSS compliant (see their UK website for details).


BY BANK TRANSFER

Please contact me and I will forward details to you for paying money directly into my business account.  Online transactions are usually completed within a couple of hours using the Faster Payments Service that most UK banks now use, and often the funds are transferred within minutes of making the online transaction.


BY CHEQUE OR POSTAL ORDER

Please make these payable to Anne Fontenoy and send them to the above address.  N.B. Post dated cheques are not accepted.


BY CASH

I will accept cash for goods sold in person to you or if cash is sent by an insured service such as Royal Mail Next Day Guaranteed Post..


SHIPPING COSTS


NOTECARDS AND NOTELETS, GICLEE PRINTS, HAND PAINTED SILK SCARVES, ACCESSORIES AND READY-TO-WEAR DRESSES

Small orders for cards and notelets, allow 3 to 5 working days for delivery, recycled 300 gsm cards allow 2 to 4 weeks for delivery. For  Fine Art cards allow between 1 to 3 weeks as card may need to be purchased to make the cards.  Scarves, accessories and ready-to-wear dresses will be sent from stock within 5 working days of receipt of a paid order.


UK P&P 1st Class insured and signed for delivery

£2 to £9.99  = £2

£10 to £24.99 = £3.50

£25 to £74.99 = £5

£75 to £149.99 = £7

£150 and up = £10


PRINTS are made to order and are usually dispatched within 2 to 3 weeks of receipt of a paid order. Prints without a back mat will be sent in a tube.  P&P for framed images, on request.



DESPATCH DATE Customers will be advised when the goods are despatched and the expected delivery date.

If you place an order as a result of visiting my website you are entering into a legally binding contract to which English law applies.

OVERSEAS ORDERS

If you are based outside the UK, and wish to place an order, please contact me before placing an order.  This is so that I can contact my shipping agents and any relevant authorities to clarify export procedures (and country specific requirements for the EU) before confirming any orders.




ONE-OFF CLOTHES PLUS ART & DESIGN WORKS

To order a one off garment, or for art and design commissions, please make an appointment to see me.  I am happy to receive preliminary enquiries by e-mail, post, fax or phone.  


TERMS & CONDITIONS FOR PRIVATE ORDERS FOR MADE TO ORDER CLOTHES


In these Terms & Conditions 'Anne Fontenoy' is referred to as 'the Proprietor', the Commissioner as 'the Customer' and the garment as 'the Work'.


  1. ESTIMATE.  All prices are estimated.  Labour Fees are calculated at an hourly rate of £12.50, Design Fees at an hourly rate of  £25.  Fabric and haberdashery costs are subject to supplier's prices prevailing during this contract.  Estimates for Labour and Design Fees are valid for 3 months from the date of this contract.  Any changes to the preliminary design will be charged for in addition to this estimate, as will additional labour and material costs.  A final account will be given on completion.  VAT is N/A.


  1. PAYMENT TERMS.  DEPOSIT, including Design Fee are payable on confirmation of the order.  BALANCE due by completion date.  The Design Fee is non-returnable.  Payment is accepted as cash, cheques, POs, Bank Transfer, PayPal and credit and debit card payments via PayPal.  Post-dated cheques are not accepted.  5 working days clearance is allowed on cheques before purchase of materials or commencement of work.  Please make Cheques/POs payable to:  ANNE FONTENOY.  The Proprietor retains all title in goods until the final balance is paid when ownership passes to the Customer.


  1. COLLECTION/DELIVERY.   In general, goods shall be collected from the proprietor.  If delivery is requested by the Customer, quotes for packaging and delivery will be given in writing to the Customer for approval prior to despatch.


  1. ACCEPTANCE.  All garments are sewn entirely by hand.  The Proprietor will use her aesthetic judgement to create the Work and diligence and skill will be exercised in the execution of the Work.  The Customer will accept the Work once completed unless the Work is not substantially in accordance with the description.  Any defects in workmanship or materials will be rectified within 30 days of collection/delivery.


  1. DEFECTIVE WORK. If there is any serious defect this must be advised in writing to the proprietor within 7 days of collection/delivery.  If the Work is found to be totally defective all monies paid save the Design Fee will be reimbursed to the Customer and this will be the limit of the Proprietor's liability.  No compensation will be paid for contingent losses.


6. TERMINATION.

6.1  The Proprietor may terminate the Work if the Customer is late in paying any sum due and a written request will be made for any outstanding amount.  If the amount due is not paid within 30 days of written notice the Proprietor may terminate the Work and be entitled to a proportion of the final instalment due based on the stage of completion reached at the time of termination.  If the Work is terminated legal title and ownership in the Work will be retained by the Proprietor.  The Customer may terminate the work at any time, but the Design Fee is not returnable and the Proprietor will be due all sums for all material costs and all fees for labour based on the stage of completion reached at the time of termination.


6.2  Termination will be automatic on the death or incapacity of the Proprietor whereupon all payments due should be paid to the Proprietor or her estate and the Customer may keep the Work in progress and any preliminary designs for the purpose only of completing the Work by a person approved by the Proprietor or her estate.  If the Customer does not wish to have the Work completed the Work in progress and the preliminary designs shall belong to the Proprietor or her estate.


6.3  The Proprietor will not be treated as being in default if there is any delay in completing the Work due to any cause beyond the Proprietor's reasonable control and time shall not be of the essence in the performance of this contract.


  1. PROPRIETARY RIGHTS.  The copyright and all related rights in dressmaking patterns, and the copyright and all related rights in the case of Surface Decoration and Works of Artistic Craftsmanship, shall always remain the exclusive property of the Proprietor and the Customer will at all times acknowledge the Proprietor as creator, unless there is substantial collaboration in the work, in which case there may be joint ownership in the copyright.  Any reproduction rights will require separate agreement in writing.  The Proprietor warrants that the Work will be original and will not infringe the copyright of any third party.


UK law is applicable to all contracts.
